Terms & Conditions
Who can use Homalaya, how listings, payments and enquiries work, and what is not allowed. Last updated 13 October 2026.
1. About these terms
These Terms & Conditions are an agreement between you and Ira Internet Services Private Limited ("Homalaya", "we", "us"), which runs homalaya.com. By using Homalaya or signing in, you agree to them and to our Privacy Policy. If you do not agree, please do not use Homalaya.
2. Who can use Homalaya
- You must be 18 or older and able to enter into a binding contract under Indian law.
- One account per person and per phone number. Do not sign in as someone else.
- Give true, current information, and keep your phone and Google account secure: you are responsible for what is done from your account.
- Tell us straight away if you think someone else has used your account.
3. What Homalaya is
Homalaya is an online platform where owners, builders and dealers list homes to rent or buy, and renters and buyers find them and get in touch. We are an intermediary under the Information Technology Act, 2000.
We are not a broker or agent. We do not own, inspect or guarantee any property, and we are not part of any agreement between people who meet on Homalaya. Before paying anyone or signing anything, check the property, its papers and the person yourself.
4. Listing a property
- List only a property you own, or that you are the builder of or a dealer authorised by its owner to list, and say which when you list it.
- Keep the details true and current: price or rent, deposit, area, availability and photos. Remove or hide the listing once the property is no longer available.
- If you are selling a property that must be registered under RERA, follow RERA, including showing its registration where required.
- Photos must be of this property and yours to use. Do not show people, identity documents, or anything private.
- We check listings and photos before they go public. If a listing breaks these terms or the law, we may reject, hide or remove it, or edit it only to take out what cannot be published.
- Your private address and exact map pin are never shown publicly; listings show an approximate area.
- Before you publish, we ask whether signed-in renters or buyers may WhatsApp or call you. Nothing is shared until you say yes. If you do, they can see your number on that listing; you can turn this off at any time with “Tenants can WhatsApp me”.
- A listing stays live for the days you paid for and then ends. You can hide, renew or delete it from My listings. Deleting is permanent.
5. Fees, payments and refunds
- Publishing or renewing a listing costs the price shown before you pay, including GST, for the number of days shown with it.
- Payments are processed by Cashfree Payments. We never see your card, UPI or bank details.
- A listing goes live only after Cashfree confirms your payment and the listing has at least one processed photo. Its paid days start when it goes live. Each photo stays private until we approve it.
- If a payment fails, is cancelled or you leave the payment page, nothing is charged and you can try again.
- If you are charged but your listing does not go live, or you are charged twice, contact us with the payment details. We will publish the listing or refund the extra payment.
- Fees are not refunded when you hide or delete a listing, or when we remove it for breaking these terms. Any paid days left are lost.
- If we remove a listing for a reason that is not your doing, such as a mistake on our side, we will restore it or refund the fee.
- Refunds go back to the original payment method. How long they take depends on Cashfree and your bank.
- Every payment gets a GST invoice, sent to you and kept in Account › Payment history.
6. Contacting owners
- Contact owners only about a genuine interest in their property.
- When you send an enquiry, the owner receives your name, phone number and message so they can reply.
- Use contact details you receive on Homalaya only for that property. Do not spam, harass, or pass them on. This applies to owners and enquirers alike.
7. Staying safe
How we check listings
- The owner's phone is verified before they can pay for a listing.
- A listing goes live only after its payment is confirmed.
- Photos are reviewed before they appear, and automated checks flag listings and photos for a person to look at.
- Maps and search show an approximate location, never the exact address.
- Moderation, payments, activations, renewals and enquiries are recorded, so problems can be traced.
If you are looking for a home
- Look carefully at the photos, locality, price, deposit and terms before getting in touch.
- Never pay a token, deposit or fee before you have seen the property and checked the owner and the papers.
- Meet in a sensible public or known place when you go to see a property.
If you are listing
- Show only a public road or area in the listing; share flat or house details directly, when you choose to.
- Do not ask renters or buyers for sensitive documents before a genuine viewing and agreement.
Report a listing that looks fake, misleading, duplicated or unsafe to [email protected], with its link and what is wrong.
8. What is not allowed
- Posting anything you have no right to, or that is false, misleading, or pretends to be someone else.
- Content that is unlawful under Indian law, including the kinds listed in rule 3(1)(b) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021: for example obscene, defamatory, invasive of privacy, harmful to children, hateful, or threatening India's unity, security or public order.
- Refusing or describing renters or buyers in ways the law forbids.
- Copying, scraping or bulk-downloading listings or contact details, or using Homalaya to collect other people's data.
- Spam, malware, or anything that interferes with Homalaya's security or working.
- Arranging payments for listing on Homalaya outside Homalaya.
9. Your content
You keep ownership of your listing text and photos. While the listing exists, you let us host, show, resize, watermark and promote them on Homalaya and in our own promotion of your listing, without payment. You confirm you have the right to give us this permission.
10. Suspension and closing accounts
We may refuse, hide or remove content, or suspend or close an account, that breaks these terms or the law or puts other people at risk. We will tell you why, unless the law or someone's safety prevents it. You can stop using Homalaya at any time, and delete your account from Account settings.
11. Our responsibility
We work to keep listings accurate and Homalaya available, but we provide it as it is and cannot promise it will always be accurate or available. We are not responsible for what other people say or do on Homalaya, for any property, or for agreements or disputes between users.
As far as the law allows, our total responsibility to you for any claim is limited to the fees you paid us in the 12 months before it. Nothing here limits a responsibility the law does not let us limit. If you break these terms or the law and someone claims against us because of it, you will cover our resulting losses.
12. Grievances
Complaints about Homalaya, about content on it, or about your data go to our Grievance Officer:
Rajaram Dangi, Grievance Officer
Email: [email protected]
We acknowledge complaints within 24 hours and resolve them within 15 days. Content that shows someone's private images without consent, or that impersonates someone, is dealt with within 24 hours of a complaint.
13. Data sources and licences
City and town names, states and districts from the Local Government Directory (Ministry of Panchayati Raj, Government of India), via the india-local-government-directory dataset, used under the Government Open Data License – India. 14. Changes, law and disputes
We may change these terms. We will update this page and its date, and tell you on Homalaya about changes that matter. Using Homalaya after a change means you accept it.
These terms are governed by the laws of India. The courts at Hazaribagh, Jharkhand, have jurisdiction over any dispute about them. If a part of these terms cannot be enforced, the rest still applies.
